The Ministry of Labor – Invalids and Social Affairs announces to all sectors and localities the occupational accident situation in the first 6 months of 2023 and some key solutions to proactively prevent incidents and occupational accidents in the last 6 months of 2023.
According to reports from 63/63 provinces and centrally-run cities, in the first 6 months of 2023, there were 3,201 occupational accidents (OA) nationwide (a decrease of 707 cases, equivalent to 18.09% compared to the first 6 months of 2022) affecting 3,262 victims (a decrease of 739 people, equivalent to 18.47% compared to the first 6 months of 2022) (including both the formal employment sector and the informal employment sector), of which:
– Number of fatal OA cases: 345 cases, a decrease of 21 cases, equivalent to 5.74% compared to the first 6 months of 2022 (of which, the formal employment sector: 273 cases, a decrease of 19 cases, equivalent to 6.5% compared to the first 6 months of 2022; the informal employment sector: 72 cases, a decrease of 02 cases, equivalent to 2.70% compared to the first 6 months of 2022);
– Number of fatalities from OA: 353 people, a decrease of 27 people, equivalent to 7.11% compared to the first 6 months of 2022 (of which, the formal employment sector: 281 people, a decrease of 18 people, equivalent to 6.02% compared to the first 6 months of 2022; the informal employment sector: 72 people, a decrease of 09 people, equivalent to 11.11% compared to the first 6 months of 2022);
– Number of serious injuries: 784 people, a decrease of 23 people, equivalent to 2.85% compared to the first 6 months of 2022 (of which, the formal employment sector: 715 people, an increase of 26 people, equivalent to 3.77% compared to the first 6 months of 2022; the informal employment sector: 69 people, a decrease of 49 people, equivalent to 41.53% compared to the first 6 months of 2022).
* The OA situation in the first 6 months of 2023 in both the formal and informal employment sectors decreased compared to the first 6 months of 2022, in terms of both the number of fatalities and the number of fatal OA cases.
Localities with the highest number of OA fatalities in the first 6 months of 2023, including both the formal and informal employment sectors, include: Ho Chi Minh City, Hanoi, Binh Duong, Quang Ninh.
Part I: OCCUPATIONAL ACCIDENT SITUATION IN THE FORMAL EMPLOYMENT SECTOR
I. GENERAL SITUATION
1. Number of occupational accidents
According to reports from 63/63 provinces and centrally-run cities, in the first 6 months of 2023, there were 2,931 OA cases nationwide affecting 2,989 victims, of which:
– Number of fatal OA cases: 273 cases;
– Number of fatalities: 281 people;
– Number of serious injuries: 715 people;
(Details in Appendix II).
Localities with many OA fatalities in the formal employment sector include: Ho Chi Minh City, Ha Noi, Binh Duong.
2. Comparison of the OA situation in the first 6 months of 2023 with the first 6 months of 2022
Based on statistical data, the OA situation in the first 6 months of 2023 compared to the first 6 months of 2022 is as follows:

3. Some serious occupational accidents and handling of responsibility for OAs occurring in the first 6 months of 2023
– Typical serious occupational accidents (causing fatalities and multiple injuries) occurred in localities such as: Ha Noi, Da Nang, Ha Tinh, Quang Ninh, in sectors like construction, electricity, etc.;
– In addition to some serious occupational accidents still under investigation, in the first 6 months of 2023, localities reported 07 OA cases recommended for prosecution, and 05 cases have received a Decision to Prosecute from the Police Investigation Agency.
(Details in Appendix III).
4. Occupational accident situation in specific sectors
– According to the report from the Ministry of Defense for the first 6 months of 2023, there were 18 occupational accidents (04 fatal cases) affecting 19 victims (04 fatalities, 15 injuries);
– According to the report from the Ministry of Public Security for the first 6 months of 2023, there were 47 occupational accidents (02 fatal cases, 04 cases with 02 or more victims) affecting 59 victims (12 fatalities, 08 serious injuries);
– According to the report from the Ministry of Industry and Trade, in the first 6 months of 2023, no occupational accidents occurred in the field of oil and gas exploration and exploitation (onshore);
– The Ministries of Transport, Science and Technology, and Health have not yet reported occupational accidents in their specific sectors.
II. ANALYSIS OF OA CASES FROM INVESTIGATION REPORTS IN THE FORMAL EMPLOYMENT SECTOR
Based on the analysis of received fatal occupational accident investigation reports, the Ministry of Labor – Invalids and Social Affairs provides the following assessments:
1. Fatal occupational accident situation by type of production establishment
– Joint-stock companies accounted for 32.3% of fatal accident cases and 33.55% of fatalities;
– Limited liability companies accounted for 30.30% of fatal accident cases and 32.11% of fatalities;
– State-owned enterprises and administrative/non-business units accounted for 16.21% of fatal accident cases and 16.35% of fatalities;
– 100% foreign-invested enterprises accounted for 4.74% of accident cases and 4.22% of fatalities.
2. Business and production sectors with many fatal occupational accidents
– The construction sector accounted for 13.33% of total accident cases and 14.77% of total fatalities;
– The production of construction materials sector accounted for 13.11% of total accident cases and 14.15% of total fatalities;
– The mining sector accounted for 11.2% of total cases and 10.82% of total fatalities;
– The textiles, garments, and footwear sector accounted for 6.08% of total cases and 6.44% of total fatalities;
– The services sector accounted for 5.29% of total cases and 5.47% of total fatalities.
3. Main injury factors causing the most fatalities
– Traffic accidents accounted for 29.75% of total cases and 29.34% of total fatalities;
– Falls from height, falling accounted for 22.9% of total cases and 22.51% of total fatalities;
– Electric shock accounted for 10.12% of total cases and 10.72% of total fatalities;
– Collapse accounted for 9.23% of total cases and 9.2% of total fatalities;
– Objects thrown, struck, or hit accounted for 8.05% of total cases and 8.75% of total fatalities.
4. Main causes of fatal occupational accidents
* Causes due to the employer accounted for 37.26% of total cases and 38.21% of total fatalities, specifically:
– Due to work organization and working conditions: 18.55% of total cases and 17.44% of total fatalities;
– Employer did not develop safe working procedures and measures: 11.04% of total cases and 12.48% of total fatalities;
– Employer did not provide occupational safety training or provided inadequate training to workers: 3.52% of total cases and 3.45% of total fatalities;
– Equipment did not ensure occupational safety: 2.1% of total cases and 2.5% of total fatalities;
– Employer did not provide personal protective equipment (PPE) or PPE was inadequate: 2.05% of total cases and 2.34% of total fatalities.
* Causes due to the employee accounted for 23.72% of total cases and 23.93% of total fatalities, specifically:
– Employee violated occupational safety procedures and standards: 12.55% of total cases and 12.67% of total fatalities;
– Employee did not use provided personal protective equipment and safety devices: 11.17% of total cases and 11.26% of total fatalities.
* The remaining 39.02% of total accident cases and 37.86% of total fatalities were due to other causes such as: traffic accidents, accidents caused by others, objective and unavoidable reasons.
III. GENERAL ASSESSMENT OF THE OA SITUATION AND THE INVESTIGATION AND REPORTING OF OAs IN THE FORMAL EMPLOYMENT SECTOR
1. OA situation in the first 6 months of 2023 compared to the first 6 months of 2022
In the first 6 months of 2023, within the formal employment sector, the number of OA cases decreased, the total number of victims decreased, the number of fatal cases decreased, and the number of fatalities decreased, but the number of serious injuries increased (Details in Table 1 above).
2. Occupational accident investigation situation
– Most OA cases were reported and investigated according to regulations. However, some localities were slow in sending investigation reports to the Ministry of Labor – Invalids and Social Affairs; the number of received reports only accounted for 24.8% of the total fatal OA cases;
– In the first 6 months of 2023, provinces such as Lang Son, Lao Cai, Dien Bien, Binh Duong, Hanoi, Tuyen Quang, Quang Ninh… were localities that submitted OA investigation reports promptly as required to the Ministry of Labor – Invalids and Social Affairs for consolidation and monitoring.
3. Quality of occupational accident reporting in the first 6 months of 2023
– In the first 6 months of 2023, 63/63 localities submitted reports on the OA situation as stipulated in Decree No. 39/2016/ND-CP dated May 15, 2016, of the Government;
– The reporting rate from enterprises to the provincial Departments of Labor – Invalids and Social Affairs remains low. In the first 6 months of 2023, only about 6.55% of enterprises reported on their OA situation. The number of enterprises complying with OA reporting is insufficient. Therefore, consolidating and evaluating the nationwide OA situation still faces many difficulties.
4. Material damage
According to preliminary data from local reports, the material damage from OAs in the first 6 months of 2023 is as follows: costs for medicine, funerals, compensation for families of the deceased and the injured, etc., amounted to over 5,625 billion VND (an increase of about 3,176 billion VND compared to the first 6 months of 2022); property damage was over 701 billion VND (an increase of about 685 billion VND compared to the first 6 months of 2022); the total number of workdays lost due to occupational accidents was over 76,636 days (an increase of about 28,057 days compared to the first 6 months of 2022).
Part II: OA SITUATION FOR WORKERS IN THE INFORMAL EMPLOYMENT SECTOR
I. OCCUPATIONAL ACCIDENT SITUATION
According to reports from 63/63 provinces and centrally-run cities, there were 270 OA cases nationwide affecting 273 workers in the informal employment sector, of which:
– Number of fatal OA cases: 72 cases;
– Number of fatalities: 72 people;
– Number of serious injuries: 69 people;
(Details in Appendix IV).
Localities with the highest number of occupational accident fatalities in the first 6 months of 2023 include: Ha Noi, Gia Lai, Bac Lieu.
According to statistical data, the OA situation in the first 6 months of 2023 compared to the first 6 months of 2022 is as follows:

II. SITUATION OF OA INVESTIGATION AND REPORTING QUALITY IN THE FIRST 6 MONTHS OF 2023
In the first 6 months of 2023, the investigation of OAs in the informal sector has not been fully implemented according to legal regulations. The creation of OA records for workers without labor contracts by Commune-level People’s Committees is still very limited.
All 63/63 provinces and centrally-run cities have reported OA statistics for workers in the informal sector as stipulated in Decree No. 39/2016/ND-CP dated May 15, 2016, of the Government; of these, 33 localities reported OAs, and 30 localities reported no OAs (details in Appendix IV).
Part III: KEY SOLUTIONS TO BE IMPLEMENTED IN THE LAST 6 MONTHS OF 2023
Based on the situation and causes of OAs in the first 6 months of 2023, to proactively prevent and limit OAs in the coming time, the Ministry of Labor – Invalids and Social Affairs requests that ministries, sectors, localities, enterprises, organizations, employers, and employees pay attention to implementing the following key contents:
- Ministries and sectors shall direct enterprises under their management to proactively inspect occupational safety and health (OSH) work; coordinate with the Ministry of Labor – Invalids and Social Affairs to inspect and examine enterprises operating in sectors with high risks of OAs and serious incidents, such as: construction, production of construction materials, textiles, garments, footwear, mining, especially key construction projects, projects adjacent to residential areas or crowded places, lifting equipment, elevators,….
- The Ministry of Health shall enhance the implementation of guidelines and monitor the statistical reporting of OAs at medical examination and treatment facilities according to Clause 4, Article 36 of the Law on Occupational Safety and Health and Article 25 of Decree No. 39/2016/ND-CP dated May 15, 2016, of the Government, and send reports to the Ministry of Labor – Invalids and Social Affairs for consolidation as prescribed.
- Provincial and Centrally-run City People’s Committees shall direct local functional agencies to:
- Increase inspection and examination of compliance with OSH regulations by enterprises in their localities, especially in sectors with high risks of OAs and serious incidents, paying attention to the development of safe working procedures and measures within enterprises; implement OA reporting according to the Law on Occupational Safety and Health;
- Strengthen the organization of propaganda and dissemination of OSH knowledge and laws suitable for each field and profession, prioritizing propaganda and dissemination of OSH laws for workers in the informal employment sector;
- Enhance the organization of OA investigations for workers in the informal employment sector;
- Strengthen the implementation of OA prevention measures with support from the social insurance fund for occupational accidents and diseases, and report to the Ministry of Labor – Invalids and Social Affairs;
- Organize and guide District-level and Commune-level People’s Committees in the statistical reporting of OAs for workers in the informal sector; create OA records for workers in the informal sector.
- Enterprises shall strengthen the implementation of OSH work, focusing on self-inspection activities, proactively controlling and preventing hazardous and harmful factors at the enterprise, preventing OAs due to falls from height, electric shock, falling objects, and collapse; organize OSH training for employees.
- The Vietnam Chamber of Commerce and Industry (VCCI) and the Vietnam Cooperative Alliance shall propagate and mobilize employers to pay attention to developing rules, procedures, and measures for safe work, ensuring OSH, and improving working conditions at the workplace; organize propaganda and dissemination of the Law on Occupational Safety and Health to their members.
- The Vietnam General Confederation of Labor, the Central Committee of the Vietnam Farmers’ Union, and professional associations shall strengthen propaganda and mobilize workers and members to strictly adhere to safety rules and work procedures; use personal protective equipment during work to minimize OAs, ensuring the safety, health, and lives of workers./.

OA case occurred on 02/02/2023, at Nosco Shipyard Joint Stock Company (Quang Ninh), resulting in 04 deaths; 04 injuries to workers of Nosco Shipyard Joint Stock Company while performing their assigned work: cutting, repairing the spiral staircase leading down to hatch No. 5 of the ORIENTAL GLORY vessel, when a fire and explosion occurred in cargo hold No. 5.
2. A particularly serious OA case occurred on 25/5/2023, at the residential and culinary service business complex; address: 34-36 2/9 Street, Hai Chau District, Da Nang City, due to the collapse of a balcony floor beam during construction, resulting in 05 victims (02 deaths, 03 injuries) who were workers of the construction contractor (Minh Phat Phu Construction Design and Consulting One Member Co., Ltd).
3. OA case occurred on 20/6/2023, between poles 01 and 02 of the Thach Ha 2 substation branch, line 476E18.1, in Lien Phu hamlet, Thach Trung commune, Ha Tinh city, Ha Tinh province, resulting in 01 death and 02 injuries to workers of Dai Phat Construction Consulting and Trading Joint Stock Company, who suffered burns due to violating the power grid safety corridor (electrical discharge).
4. OA case occurred on 27/5/2023 at the carpentry workshop of Mr. Kieu Duy Nghiep’s family, address: Hamlet 3, Sen Phuong commune, Phuc Tho district, Hanoi City, resulting in 02 deaths and 01 serious injury due to fire and explosion.

OA case occurred on 26/8/2022, at the adjacent residential house construction site, address: 19 Nguyen Nghiem, Hoa Thanh ward, Tan Phu district, Ho Chi Minh City; constructed by Minh Khoa Construction Co., Ltd (head office: 61/607 Nguyen Van Nghi, Ward 7, Go Vap District, Ho Chi Minh City), resulting in 02 deaths and 01 injury due to a fall from height. OA conclusion on 16/01/2023, recommended prosecution.
3. OA case occurred on 16/9/2022, at the construction site of a residential house combined with an office, address: 85/20 – 85/22, Pham Viet Chanh, Ward 19, Binh Thanh District, Ho Chi Minh City; constructed by Gia Thien Arch Construction Co., Ltd (head office: 92/20/4 Xo Viet Nghe Tinh, Ward 21, Binh Thanh District, Ho Chi Minh City), resulting in 01 death due to a fall from height. OA conclusion on 09/3/2023, recommended prosecution.
4. OA case occurred on 14/10/2022, at a residential house construction site, address: 1333/34/2/6 Le Thi Cho Street, Quarter 4, Phu Thuan ward, District 7, Ho Chi Minh City; constructed by Minh Construction Design and Construction Co., Ltd (head office: 264F Bach Dang, Ward 24, Binh Thanh District, Ho Chi Minh City), resulting in 01 death due to a fall from height. OA conclusion on 16/3/2023, recommended prosecution.
5. OA case occurred on 03/11/2022, at a residential house construction site at Lot I-56, Binh Hung commune, Binh Chanh district, Ho Chi Minh City; constructed by TTT Tien Dat Construction Investment Co., Ltd (head office: 419/43/10C Le Van Luong Street, Hamlet 1, Phuoc Kien commune, Nha Be district, Ho Chi Minh City), resulting in 01 death due to the collapse of a concrete pump boom. OA conclusion on 24/3/2023, recommended prosecution.
6. OA case occurred on 28/3/2023, at Tran Quoc Vuong Auto Repair Garage (address: 790 Nguyen Van Bua, Hamlet 5, Xuan Thoi Son commune, Hoc Mon district, Ho Chi Minh City), owned by individual Tran Quoc Vuong (permanent residence: Hoa Phu hamlet, Nghia Hoa commune, Tu Nghia district, Quang Ngai province), resulting in 01 death due to being crushed by an object. OA conclusion on 19/6/2R023, recommended prosecution.
7. OA case occurred on 15/3/2023, in the freight elevator area of 14 Kindergarten (address: 958 Au Co, Ward 14, Tan Binh District, Ho Chi Minh City), managed by 14 Kindergarten (permanent residence: 958 Au Co, Ward 14, Tan Binh District, Ho Chi Minh City), resulting in 01 death due to a fall from height in the freight elevator shaft. OA conclusion on 29/6/2023, recommended prosecution.

The Investigation Police Agency, Tran Van Thoi District Police, Ca Mau Province, issued Decision No. 38/QD-DTTH on 15/02/2023, to prosecute the criminal case “Violation of regulations on occupational safety,” for the OA case that occurred on 07/01/2023 at the Song Ong Doc bridge construction site; address: Quarter 4, Song Doc Town, Tran Van Thoi District, Ca Mau Province, resulting in 01 death, a worker of Tuan Hien Co., Ltd, located in Vinh Long.
2. The Investigation Police Agency, Long Khanh City Police, Dong Nai Province, issued Decision No. 54/QD-DTTH on 12/3/2023, to prosecute the criminal case “Violation of regulations on occupational safety,” for the OA case that occurred around 16:25 on 29/8/2022 at the Steel Structure Finishing Team – Workshop 1 of ATAD Dong Nai Steel Structure Joint Stock Company, address: Lot F, Long Khanh Industrial Park, Binh Loc commune, Long Khanh city, Dong Nai province, causing the death of Mr. Nguyen Van Truong, born in 1978, an employee of ATAD Dong Nai Steel Structure Joint Stock Company. Decision No. 67/QD-DTTH on 12/3/2023, prosecuted the accused Nguyen Dang Khoi for the crime of “Violation of regulations on occupational safety” specified in Clause 1, Article 295 of the 2015 Penal Code. Occupational accident investigation conclusion on 12/6/2023.
3. The Investigation Police Agency, Trang Bom District Police, Dong Nai Province, issued Decision No. 256/QD-DTTH on 05/11/2022, to prosecute the accused Duong Huynh Duy for the crime of involuntary manslaughter due to violation of professional rules, a crime and penalty specified in Clause 1, Article 129 of the 2015 Penal Code, for the OA case that occurred around 22:00 on 31/8/22 at the production workshop of Tin Nghia Hung One Member Co., Ltd, address: Phu Son Hamlet, Bac Son commune, Trang Bom district, Dong Nai province, causing the death of Mr. Le Van Thanh, born in 1994, an employee of Viet Thermal Energy Joint Stock Company, address: 222C Linh Trung Street, Quarter 1, Linh Trung ward, Thu Duc city, Ho Chi Minh City. Occupational accident investigation conclusion on 19/6/2023.
4. The Investigation Police Agency, Long Khanh City Police, Dong Nai Province, issued Decision No. 22/QD-DTTH on 16/01/2023, “Violation of regulations on occupational safety” under Clause 1, Article 295 of the 2015 Penal Code, to prosecute the accused Pham Thi Kim Loan, born in 1989, for the OA case that occurred around 7:00 on 15/8/2022 at the Pham Van Lam Business Household, address: Group 20, Tran Nhan Tong Street, Bao Vinh B Quarter, Bao Vinh ward, Long Khanh city, Dong Nai province, causing the death of Mr. Pham Thanh Binh, born in 1999, an employee of the Pham Van Lam Business Household.
