DECREE
DETAILED REGULATIONS ON CERTAIN ARTICLES OF THE LAW ON OCCUPATIONAL SAFETY AND HEALTH REGARDING SAFETY TECHNICAL INSPECTION, occupational safety training, AND WORKPLACE ENVIRONMENT MONITORING
Pursuant to the Law on Government Organization dated June 19, 2015;
Pursuant to the Law on Occupational Safety and Health dated June 25, 2015;
At the proposal of the Minister of Labor – Invalids and Social Affairs;
The Government provides detailed regulations on certain articles of the Law on Occupational Safety and Health regarding safety technical inspection activities, occupational safety training, and workplace environment monitoring.
Chapter I: GENERAL PROVISIONS
Article 1. Scope of regulation in Decree 44/2016/ND-CP
Decree 44/2016/ND-CP provides detailed regulations on certain articles of the Law on Occupational Safety and Health regarding safety technical inspection activities, occupational safety training, and workplace environment monitoring.
Article 2. Subjects of application in Decree 44/2016/ND-CP
- Employers and employees as prescribed in Article 2 of the Law on Occupational Safety and Health.
- Public service units, enterprises, and other organizations or individuals involved in safety technical inspection activities; occupational safety training and workplace environment monitoring.
Article 3. Interpretation of terms in Decree 44/2016/ND-CP
In this Decree, the following terms are understood as:
- Inspection subjects are machines, equipment, and materials with strict occupational safety requirements listed by the Ministry of Labor – Invalids and Social Affairs.
- In-house trainers are occupational safety and health trainers employed under a contract of at least 12 months or with indefinite term.
- Training group is a group of trainees with similar work characteristics and occupational safety requirements, classified according to Decree 44/2016/ND-CP.
Chapter II: SAFETY TECHNICAL INSPECTION ACTIVITIES
Article 4. Conditions for granting the Certificate of Eligibility for Safety Technical Inspection Activities
- Organizations, including public service units or enterprises, applying for the Certificate of Eligibility for Safety Technical Inspection Activities must meet the following conditions:
- a) Established in accordance with the law and allowed to provide safety technical inspection services.
- b) Equipped with devices and tools for inspection for each object within the scope of inspection, according to inspection procedures and national technical standards on occupational safety and health.
- c) Possess sufficient technical documents for each object within the scope of inspection according to the inspection procedure.
- d) Have at least 2 inspectors employed for 12 months or more to perform inspections for each object within the scope requested for the Certificate of Eligibility.
- đ) The technical manager of inspection activities must hold a university degree in a relevant technical field and have at least 3 years of direct experience performing safety technical inspections.
- The equipment, documents, and personnel specified in points b, c, d, and đ of Clause 1 may only be used as conditions for applying for the Certificate of Eligibility for one organization.

Article 5. Dossier, procedures for granting, renewing, and reissuing the Certificate of Eligibility for Safety Technical Inspection Activities
- The dossier for granting the Certificate includes:
- a) Application for the Certificate;
- b) Copy of Business Registration Certificate for enterprises or Establishment Decision for public service units;
- c) List of equipment and tools for inspection;
- d) List of technical documents;
- đ) Documents of inspectors including:
- Copy of inspector certificate;
- Copy of employment contract.

- e) Documents of the technical manager including:
- Copy of university degree;
- Document proving inspection experience.
- e) Documents of the technical manager including:
- The dossier for renewing the Certificate includes:
- a) Application for renewal;
- b) Previously granted Certificate;
- c) Relevant documents from points b, c, d, đ, and e of Clause 1 if there are changes.
- The dossier for reissuing the Certificate includes:
- a) For amendment or supplementation, the dossier includes:
- Application for amendment/supplement;
- Previously granted Certificate;
- Documents proving the changes.
- a) For amendment or supplementation, the dossier includes:

- b) For lost or damaged Certificates, the dossier includes:
- Application for reissuance;
- Previously granted Certificate (if damaged).
- b) For lost or damaged Certificates, the dossier includes:
- Templates for the dossiers in Clauses 1, 2, and 3 are provided in Appendix Ia attached to Decree 44/2016/ND-CP.
- Procedures for granting, renewing, and reissuing the Certificate are as follows:
- a) Organizations submit one complete dossier to the competent authority as prescribed in Clause 1, Article 6, and pay the appraisal fee as regulated by the Ministry of Finance.
- For renewal, dossiers must be submitted at least 30 days before expiration.
- b) Within 30 days from receipt of a complete dossier, the competent authority shall appraise and grant, renew, or reissue the Certificate; if not granted, a written explanation with reasons must be provided.
Article 6. Competence to grant, renew, reissue, and revoke the Certificate of Eligibility for Safety Technical Inspection Activities
- The competence is specified in Appendix Ib attached to Decree 44/2016/ND-CP.
- The template of the Certificate is regulated in Appendix Ia attached to Decree 44/2016/ND-CP.
Article 7. Validity of the Certificate of Eligibility
- Five years for new or renewed Certificates.
- For reissued Certificates, validity equals the remaining time of the original Certificate.
Article 8. Revocation of the Certificate
The Certificate may be revoked in the following cases:
- Expiration of suspension without remedying the cause.
- Conducting inspection during suspension.
- Forgery or falsification of documents in the dossier.
Article 9. Standards for inspectors
- University degree or higher in a technical field relevant to the inspection subject;
- Health adequate for the job;
- At least 2 years of inspection or relevant technical work experience;
- Completed training and passed competency assessment or at least 10 years of experience in the inspection subject before Decree 44/2016/ND-CP took effect.
Article 10. Inspector certificate
- Granted to individuals meeting standards in Article 9.
- May be reissued in cases of:
- a) Amendment;
- b) Expiration;
- c) Loss or damage;
- d) After revocation (at least 6 months after revocation).
- Issued by specialized agencies of ministries competent to grant Certificates of Eligibility as in Appendix Ib, according to the inspection subject.
Article 11. Dossier for inspector certificate
- Application for inspector certificate;
- Notarized copy of university degree or original for verification;
- Documents proving compliance with requirements of Clauses 3 and 4, Article 9;
- Health certificate within 6 months;
- Copy of ID card, passport, or citizen ID;
- Two 3×4 photos within 6 months.
Article 12. Dossier for reissuing inspector certificate
- For amendment or supplementation, dossier includes:
- a) Application;
- b) Original certificate;
- c) Documents proving validity of amendment;
- d) Two 3×4 photos within 6 months.
- For expired certificates, dossier includes:
- a) Application;
- b) Original certificate;
- c) Assessment result;
- d) Health certificate within 6 months.
- For lost/damaged certificates:
- a) Application;
- b) Copy of certificate (if any) or certificate number;
- c) Two 3×4 photos within 6 months.
- For revoked certificates, dossier includes:
- a) Application;
- b) Report on compliance with authority’s requirements;
- c) Document proving completion of training and assessment after revocation for certain cases;
- d) Two 3×4 photos within 6 months.
- Templates are provided in Appendix Ic attached to Decree 44/2016/ND-CP.
Article 13. Procedures and validity of inspector certificate
- Submit one complete dossier to competent authority as per Clause 3, Article 10; may be submitted together with Certificate of Eligibility application.
- Within 5 working days, authority must grant certificate or provide written explanation if denied.
- Certificate template is in Appendix Ic.
- Validity is 5 years.
Article 14. Management and use of inspector certificate
- Inspectors must present certificate upon request; may only inspect subjects within scope of certificate.
- Revocation occurs in cases of:
- a) Forgery of dossier;
- b) Unauthorized alteration of certificate;
- c) Not working at any inspection organization for ≥12 months;
- d) Inspecting beyond scope;
- đ) Not following inspection procedures.
- The authority granting the certificate also has authority to revoke it.
Article 15. Responsibilities of Occupational Safety Technical Inspection Organizations
- Publish inspection reports to organizations and individuals using machinery, equipment, and materials with strict occupational safety requirements. Affix inspection stickers or display inspection information on the inspected object and issue the Certificate of Inspection Results (1 copy) to the organization or individual using the inspected object no later than 5 working days from the date of report publication if the inspection results meet the requirements.
- In cases where the inspected object fails to meet the requirements and poses a risk of accidents, do not issue the Certificate of Inspection Results and notify the facility to take remedial measures.
- Annually, from December 1 to 10, report the occupational safety technical inspection activities to the competent authority that issued the Certificate of Eligibility for Occupational Safety Technical Inspection.
- Ensure independence and objectivity in providing inspection services.
- Assign inspectors to attend professional training courses on occupational safety technical inspection.
- Submit revoked Certificates of Eligibility for Occupational Safety Technical Inspection and inspector certificates to the competent authority that issued the Certificate of Eligibility.
- Do not provide inspection services during the period of suspension or revocation of the Certificate of Eligibility for Occupational Safety Technical Inspection; do not use inspectors whose certificates have been revoked for inspections.
- The templates for the Certificate of Inspection Results, inspection stickers, and inspection activity reports are specified in Appendix Id issued together with Decree 44/2016/ND-CP.
Article 16. Responsibilities of Organizations and Individuals Using Machinery, Equipment, and Materials with Strict Occupational Safety Requirements
- Select an occupational safety technical inspection organization for initial inspection before use or periodic inspection during the use of machinery, equipment, and materials with strict occupational safety requirements; only put into use machinery, equipment, and materials that have passed inspection.
- Declare to the local Department of Labor, War Invalids, and Social Affairs within 30 days before or after putting into use machinery, equipment, and materials with strict occupational safety requirements, unless otherwise regulated by specialized laws.
- Keep the occupational safety technical records of inspected objects according to national technical standards on occupational safety and hygiene. In the case of transfer (or lease) of inspected objects, the seller (or lessor) must hand over complete technical safety documents to the buyer (or lessee).
- Facilitate the inspection organization in performing inspections, prepare all relevant technical documents for inspectors, and appoint a representative to witness the inspection process.
- Implement the recommendations of the inspection organization to ensure safety during the use of inspected objects. Do not continue to use objects that fail inspection or exceed the inspection validity period.
- Manage, use, and dispose of inspected objects according to national technical standards on occupational safety and hygiene and the manufacturer’s instructions.
- The template for the declaration letter on the use of machinery, equipment, and materials with strict occupational safety requirements is specified in Appendix Id issued together with Decree 44/2016/ND-CP.
Chapter III: OCCUPATIONAL SAFETY AND HYGIENE TRAINING ACTIVITIES
Section 1. TARGETS, CONTENT, AND GENERAL REQUIREMENTS OF TRAINING ACTIVITIES
Article 17. Targets for Occupational Safety and Hygiene Training Courses
The subjects specified in Article 14 of the Law on Occupational Safety and Hygiene are categorized into the following groups:
- Group 1: Managers in charge of occupational safety and hygiene, including:
- a) Heads of units, production or business establishments, departments, branches; those in charge of production, business, or technical departments; workshop managers or equivalents;
- b) Deputies of the heads as specified in point a, assigned to oversee occupational safety and hygiene.
- Group 2: Individuals working on occupational safety and hygiene, including:
- a) Full-time or part-time occupational safety and hygiene staff of the establishment;
- b) Persons directly supervising occupational safety and hygiene at the workplace.
- Group 3: Workers performing tasks with strict occupational safety and hygiene requirements, as listed in the tasks issued by the Ministry of Labor, War Invalids, and Social Affairs.
- Group 4: Workers not included in groups 1, 2, 3, or 5, including apprentices, interns, or probationary workers.
- Group 5: Medical personnel.
- Group 6: Safety and hygiene officers as specified in Article 74 of the Law on Occupational Safety and Hygiene.

Article 18. Occupational Safety and Hygiene Training Content
- Group 1 Training
- a) System of policies and laws on occupational safety and hygiene;
- b) Professional skills in occupational safety and hygiene: Organization, management, and implementation of occupational safety and hygiene regulations at the establishment; defining responsibilities and delegating authority; basic knowledge of hazards, preventive measures, and improving working conditions; safety culture in production and business.
- Group 2 Training
- a) System of policies and laws on occupational safety and hygiene;
- b) Professional skills in occupational safety and hygiene: Organization, management, implementation of regulations; drafting rules, procedures, and measures; defining responsibilities and delegating authority; safety culture; knowledge of hazards, prevention, and improvement; annual safety plan execution; risk assessment and emergency planning; occupational safety management systems; self-inspection; accident investigation; requirements for inspection, training, and environmental monitoring; management of machinery, equipment, materials, and substances with strict safety requirements; communication, training, first aid, occupational disease prevention; awards, discipline, statistics, and reporting.
- c) Specialized training content: Comprehensive knowledge of machinery, equipment, materials, and hazardous substances; safe work procedures for objects with strict occupational safety requirements.
- Group 3 Training
- a) System of policies and laws on occupational safety and hygiene;
- b) Basic knowledge: Policies for workers, hazards at workplace, improvement methods, safety officer network functions, safety culture, rules and signs, use of safety equipment, first aid, and occupational disease prevention;
- c) Specialized training: Knowledge of hazardous machinery, equipment, materials, risk assessment, safe work procedures, and occupational safety techniques related to the worker’s tasks.
- Group 4 Training
- a) Basic occupational safety and hygiene knowledge: Rights and obligations of employers and workers; workplace hazards; safety rules and culture; first aid and disease prevention;
- b) On-site training: Work procedures and specific occupational safety and hygiene requirements at the workplace.
- Group 5 Training
- a) System of policies and laws on occupational safety and hygiene;
- b) Professional skills in occupational safety and hygiene;
- c) Training for Occupational Health Certification: Hazard assessment, workplace monitoring, occupational disease records, common occupational diseases and prevention, medical examination organization, first aid, epidemic prevention, food safety, nutrition, workplace health promotion, occupational hygiene planning, education, and record management in coordination with safety officers as per Article 72 of the Law.
- Group 6 Training:
-
- Workers participating in the safety officer network receive additional training on the skills and methods of safety officer activities beyond the basic occupational safety training.

Article 19. Training Duration
Initial training duration is specified as follows:
- Groups 1 and 4: Minimum total training time is 16 hours, including assessment time.
- Group 2: Minimum total training time is 48 hours, including theory, practical, and assessment.
- Group 3: Minimum total training time is 24 hours, including assessment.
- Group 5: Minimum total training time is 56 hours, including assessment. Of which, the time for Occupational Health Certification training is at least 40 hours, and safety and hygiene certificate training is at least 16 hours.
- Group 6: Minimum total training time is 4 hours in addition to previously trained occupational safety content.
Article 20. Framework Programs and Training Materials under Decree 44/2016/ND-CP
- The Ministry of Labor, War Invalids, and Social Affairs coordinates with relevant ministries to issue detailed framework programs for specialized training according to the framework program in Appendix IV of Decree 44/2016/ND-CP.
- Training organizations and enterprises shall develop training programs and training materials based on the framework program suitable to the training conditions and requirements.
Article 21. Training, Refresher Courses, Skills Updates, and Periodic Training
- Update knowledge and skills on occupational safety and hygiene as per Clause 1, Article 14 of the Law on Occupational Safety and Hygiene.

- At least every 2 years, from the date the training certificate or safety card becomes valid, trainees must attend refresher courses to review and update knowledge and skills. Training duration is at least 50% of the initial training time. Medical personnel update knowledge as per point c, Clause 3, Article 73 of the Law.
- Periodic training according to Clause 4, Article 14 of the Law.

- Group 4 workers receive at least annual training to review and update knowledge and skills. Duration is 50% of the initial training.
- Training when job duties, equipment, technology change, or after long leave
- a) Job or equipment/technology change: Training on occupational safety relevant to the new job or equipment must be conducted before assignment.

- If trained within 12 months before the change, already trained content may be exempted.
- b) Returning to work after leave: If the facility is inactive or the employee has been on leave for 6 months or more, re-training is required as for initial training. Duration is 50% of the initial training.

Section 2. OCCUPATIONAL SAFETY AND HYGIENE TRAINERS
Article 22. Standards for Occupational Safety and Hygiene Trainers under Decree 44/2016/ND-CP
Occupational Safety and Hygiene Trainers (hereinafter referred to as “trainers”) must meet the following standards:
- Training on the system of occupational safety and hygiene laws
-
- Trainers on the system of occupational safety and hygiene laws must hold a university degree or higher and have at least 5 years of experience in developing policies, laws, management, inspection, and supervision related directly to occupational safety and hygiene at relevant authorities.
- Training on occupational safety and hygiene operations and basic knowledge of occupational safety and hygiene
- Trainers on occupational safety and hygiene operations and basic knowledge must hold a university degree or higher in a technical field and meet one of the following criteria:
- a) At least 5 years of experience in developing policies, laws, management, inspection, and supervision related directly to occupational safety and hygiene at relevant authorities;
- b) At least 7 years of experience in occupational safety and hygiene at public service units or enterprises and must have attended professional and training methodology courses.
- Trainers on occupational safety and hygiene operations and basic knowledge must hold a university degree or higher in a technical field and meet one of the following criteria:
- Specialized theoretical training
- Trainers for specialized theoretical training must hold a university degree or higher in a field relevant to the training and meet one of the following criteria:
- a) At least 5 years of experience in developing policies, laws, management, inspection, and supervision related directly to occupational safety and hygiene at relevant authorities;
- b) At least 5 years of experience in work with strict occupational safety and hygiene requirements and participation in professional and training methodology courses.
- Trainers for specialized theoretical training must hold a university degree or higher in a field relevant to the training and meet one of the following criteria:
- Practical training:
- a) Practical training for Group 2: Trainers must have a college degree or higher, relevant to the training field, and be proficient in practical work with machinery, equipment, chemicals, and tasks applied in the practical training program;
- b) Practical training for Group 3: Trainers must have an intermediate degree or higher relevant to the training field; at least 5 years of experience in work with strict occupational safety and hygiene requirements, or in related occupational safety and hygiene work at the facility;
- c) Practical training for Group 4: Trainers must have a technical intermediate degree or higher relevant to the training field, or at least 5 years of practical work experience;
- d) Practical training in first aid and emergency response: Trainers must have a college degree or higher in medical specialization and at least 3 years of direct experience in first aid, emergency response, or hold a medical doctor qualification;
- đ) Trainers providing practical training as per points a, b, and c above must also participate in a training methodology course on occupational safety and hygiene training or have at least 5 years of experience in developing policies, laws, management, inspection, and supervision related directly to occupational safety and hygiene at relevant authorities.
- Training on occupational health specialization
- Trainers must hold a medical doctor degree or higher and meet one of the following criteria:
- a) At least 5 years of experience in developing policies, laws, management, inspection, and supervision related directly to occupational safety and hygiene at relevant authorities;
- b) At least 5 years of experience in work related to occupational diseases, occupational hygiene, first aid, emergency response, nutrition, epidemic prevention, and food safety.
- Trainers must hold a medical doctor degree or higher and meet one of the following criteria:
- Every 2 years, trainers must attend refresher courses to update knowledge, information, policies, laws, science, and technology on occupational safety and hygiene at least once, except for trainers specialized in occupational hygiene, occupational health, first aid, emergency response, or occupational disease management.

Article 23. Determining Work Experience or Time Spent in Occupational Safety and Hygiene Training
- Agencies, public service units, enterprises, and other organizations are responsible for confirming the work experience or time spent by employees in occupational safety and hygiene training at their organization.
- The Ministry of Labor, Invalids, and Social Affairs shall provide detailed regulations for Clause 1 of this Article.
Section 3. TRAINING CERTIFICATES, SAFETY CARDS, AND CERTIFICATES OF OCCUPATIONAL HEALTH PROFESSIONAL COMPETENCE
Article 24. Management of Issuance of Training Certificates, Safety Cards, and Certificates of Occupational Health Professional Competence
- Issuance of Training Certificates
- a) Training organizations or eligible enterprises may self-issue training certificates to trainees in Groups 1, 2, 5, and 6 after passing assessments;
- b) Training Certificates follow Form No. 08, Appendix II, issued with Decree 44/2016/ND-CP.
- Issuance of Safety Cards
- a) Employers issue Safety Cards to trainees in Group 3 after passing the assessment. Training organizations issue Safety Cards to workers without labor contracts;
- b) Safety Cards follow Form No. 06, Appendix II, issued with Decree 44/2016/ND-CP.
- Issuance of Certificates of Occupational Health Professional Competence
- a) Training organizations, self-training enterprises, or medical facilities (including professional health training institutions, other educational institutions with health-related majors, and central preventive health research institutes) may issue Certificates of Occupational Health Professional Competence to trainees in occupational health after passing the assessment;
- b) Certificates follow Form No. 07, Appendix II, issued with Decree 44/2016/ND-CP.
- Training Log for Group 4
- a) Employers record the training results of Group 4 trainees in the Training Log at the production or business facility;
- b) The Training Log follows Form No. 11, Appendix II, issued with Decree 44/2016/ND-CP.
- Training organizations, eligible self-training enterprises, and production or business facilities shall maintain logs for issuing Training Certificates, Safety Cards, and Certificates of Occupational Health Professional Competence; Training Log for Group 4 is maintained according to Forms No. 09, 10, and 11, Appendix II, issued with Decree 44/2016/ND-CP.


Article 25. Validity and Renewal of Training Certificates, Safety Cards, and Certificates of Occupational Health Professional Competence under Decree 44/2016/ND-CP
- Training Certificates and Safety Cards are valid for 2 years. Certificates of Occupational Health Professional Competence are valid for 5 years.
- Within 30 days before expiry, employers must prepare a list of personnel to be re-issued certificates, together with training results or proof of knowledge and skills updates on occupational safety and hygiene under Clause 1, Article 21 of Decree 44/2016/ND-CP, and submit to the training organization, medical facility, or self-training enterprise as per Articles 26 and 29. If assessment results are satisfactory, new certificates are issued according to this Decree.

Article 27. Authority to Issue, Reissue, Renew, and Revoke Certificates of Operational Eligibility for Training Organizations under Decree 44/2016/ND-CP
- The Ministry of Labor, Invalids and Social Affairs (MOLISA) and the Departments of Labor, Invalids and Social Affairs have the authority to issue, reissue, renew, and revoke Certificates of Operational Eligibility for training organizations.
- MOLISA has the authority to issue, reissue, renew, and revoke Certificates of Operational Eligibility for the following training organizations:
- a) Training organizations established by ministries, central agencies, state-owned corporations or general companies under ministries and central agencies;
- b) Category B and C training organizations;
- c) Group 5 training organizations as regulated in Clause 5, Article 26 of Decree 44/2016/ND-CP.
- Provincial and municipal Departments of Labor, Invalids and Social Affairs have the authority to issue, reissue, renew, and revoke Certificates of Operational Eligibility for training organizations. Category A certificates are issued for organizations established by the competent provincial/municipal authority; enterprises and public service units are managed locally.
Article 28. Dossiers and Procedures for Issuing, Reissuing, Renewing Certificates of Operational Eligibility for Training Organizations, and Recognition of Medical Facilities Qualified to Train for Occupational Health Certificates
- The dossier for new issuance of a Certificate of Operational Eligibility includes:
- a) Application for issuance of Certificate of Operational Eligibility according to Form No. 01, Appendix II, issued with Decree 44/2016/ND-CP;
- b) Explanatory report on the training scale, conditions, and implementation solutions according to Form No. 02, Appendix II, issued with this Decree;
- c) Copy of Establishment Decision or Investment Certificate, or Investment Certificate also serving as Enterprise Registration Certificate for enterprises established before July 1, 2015;
- d) Copy of appointment decision or assignment of the head and person in charge of training;
- đ) List of facilities; list of managers and trainers along with the following documents:
- Certified copy of documents proving trainers meet training eligibility;
- Certified copy of documents regarding facilities, including decisions assigning facilities by competent authorities, contracts, purchase invoices, donation or transfer documents; lease contracts or partnership agreements if the training organization rents or partners with another facility to meet equipment requirements under Article 26 of this Decree;
- Detailed training program and materials for occupational safety and hygiene training.
- The dossier for reissuance of a Certificate of Operational Eligibility includes:
- a) In case of damage or loss:
- Explanatory letter requesting reissuance;
- Copy of the previously issued certificate (if available).
- a) In case of damage or loss:

- b) In case of amendment or expansion of operational scope:
- Letter requesting amendment or expansion of operational scope;
- Previously issued certificate;
- Documents proving capacity of trainers, training programs, and facilities corresponding to the requested expansion scope.
- b) In case of amendment or expansion of operational scope:
- The dossier for renewal of a Certificate of Operational Eligibility includes:

- Letter requesting renewal of the Certificate of Operational Eligibility;
- Documents and materials as specified in points c, d, and đ of Clause 1 of this Article.
- Procedures for issuing, reissuing, and renewing Certificates of Operational Eligibility:
- a) Organizations requesting issuance, reissuance, or renewal must submit a complete dossier to the competent authority under Article 27 of this Decree for appraisal and issuance; pay appraisal fees as regulated by the Ministry of Finance.
- For renewal requests, the training organization must submit the dossier at least 30 days before the certificate expires.
- b) Within 30 days from receiving a complete dossier, the competent authority must appraise and issue the Certificate of Operational Eligibility. If not issued, the authority must notify in writing with reasons.
- Procedure for announcing medical facilities qualified to train for occupational health certificates
-
- a) Before training to issue occupational health certificates, the head of the medical facility shall submit an application to the Ministry of Health (for organizations under ministries/agencies) or the Department of Health (for organizations under provincial/municipal management) to announce eligibility for training;
- The application includes documents similar to Clause 1 of this Article.
- b) Within 30 days of receiving a complete application, the Ministry or Department of Health shall announce eligibility on their official portal. If conditions are not met, a written explanation must be provided.
Article 29. Self-Training Enterprises for Occupational Safety and Hygiene
- Employers are responsible for organizing training and accountable for training quality for Group 4 workers through one of the following methods:
- a) Organize training themselves if meeting trainer eligibility requirements under this Decree;
- b) Hire a training organization.
- Procedures for evaluating operational eligibility of self-training enterprises:
- a) Enterprises intending to self-train must prepare a dossier proving operational eligibility like training organizations, except for conditions in point a, Clause 2, Article 26 of this Decree, and submit to the competent authority under Article 27;
- b) Within 30 days of receiving a complete dossier, the competent authority must review and notify the enterprise of unmet conditions;
- If no notification is given within 30 days, the enterprise is allowed to self-train within the requested scope.
-
- c) After 5 years from the date of initial eligibility evaluation, the enterprise must submit a dossier for reassessment if it wishes to continue self-training.
Article 30. Forms and Validity Periods for Issuing, Reissuing, and Renewing Certificates of Operational Eligibility
- Certificate of Operational Eligibility
- a) Issued by MOLISA according to Form No. 03, Appendix II, issued with Decree 44/2016/ND-CP;
- b) Issued by Provincial/Municipal Departments of Labor, Invalids and Social Affairs according to Form No. 04, Appendix II, issued with Decree 44/2016/ND-CP.
- The validity period is 5 years for new issuance or renewal. For reissuance, the validity corresponds to the remaining period of the previously issued certificate.
Article 31. Revocation of Certificates of Operational Eligibility under Decree 44/2016/ND-CP
Certificates of Operational Eligibility are revoked in the following cases:
- Upon expiration of suspension or revocation periods by a competent authority due to violations not remedied;
- Conducting training activities while under suspension or revocation by a competent authority.
Section 5. TRAINING FOR NON-CONTRACTED EMPLOYEES
Article 32. Support for Training Workers in Jobs with Strict Occupational Safety and Hygiene Requirements
- Priority support for occupational safety and hygiene training costs is for workers from poor households, near-poor households, newly escaped-poor households, ethnic minorities, war veterans, and primary relatives of war veterans, who work without labor contracts in jobs with strict occupational safety and hygiene requirements.
- Principles of support
- a) One-time support for training cost per job with strict occupational safety and hygiene requirements;
- b) Full participation in training and passing assessment to be issued a Safety Card;
- c) Support provided directly to workers or through an occupational safety and hygiene training organization.
- Support is based on actual training costs but not exceeding 50% of the base salary per person per training course as regulated by the Government at the time of training.
- Funding is allocated from the regular budget of the Ministry of Labor, Invalids and Social Affairs according to the current state budget classification.
- Departments of Labor, Invalids and Social Affairs at all levels prepare annual training support budget estimates, submit to financial authorities at the same level, for approval of funds to support training for the subjects under Clause 1 of this Article in the state budget. Budgeting, allocation, disbursement, and finalization follow state budget law.
- The Ministry and Departments of Labor, Invalids and Social Affairs organize occupational safety and hygiene training for workers based on approved funding.
Chapter IV: OCCUPATIONAL ENVIRONMENT MONITORING ACTIVITIES
Section 1. ORGANIZATION OF OCCUPATIONAL ENVIRONMENT MONITORING ACTIVITIES
Article 33. Conditions for Organizations Conducting Occupational Environment Monitoring
Organizations conducting occupational environment monitoring must meet the following conditions:
- Public service units or enterprises providing occupational environment monitoring services.
- Have sufficient personnel to perform occupational environment monitoring as follows:
- a) Personnel directly responsible for occupational environment monitoring must have the following qualifications:
- Bachelor’s degree or higher in health, environment, or biochemistry;
- At least 2 years of experience in occupational environment monitoring or 5 years in preventive medicine;
- Certificate in occupational environment monitoring training.
- a) Personnel directly responsible for occupational environment monitoring must have the following qualifications:

- b) At least 5 employees on fixed-term contracts of 12 months or longer, or indefinite-term contracts, with the following qualifications:
- Technical qualifications of intermediate level or higher in health, environment, or biochemistry; at least 60% must have a bachelor’s degree or higher;
- Certificate in occupational environment monitoring training.
- b) At least 5 employees on fixed-term contracts of 12 months or longer, or indefinite-term contracts, with the following qualifications:
- Possess facilities, equipment, tools, chemicals, and capacity meeting the minimum requirements as follows:
- a) Monitoring harmful factors in the occupational environment
- Measure, test, and analyze in the field and laboratory microclimatic factors including: temperature, humidity, wind speed, and heat radiation;
- Measure, test, and analyze physical factors including: light, noise, vibration by frequency range, radiation, electromagnetic fields, ultraviolet radiation;
- Assess occupational exposure factors, including: microorganisms, allergens, sensitizers, solvents;
- Assess labor workload and some occupational psychophysiological indicators (Ergonomics): physical workload, psychological stress, and ergonomic assessment of work positions.
- Sample, preserve, measure, test in the field and analyze in the laboratory at least 70% of the following factors:
- Particulate dust; analyze silica content in dust, metal dust, coal dust, talc, cotton dust, and asbestos dust;
- Minimum chemical factors NOx, SOx, CO, CO2, organic solvents (benzene and homologues – toluene, xylene), mercury, arsenic, TNT, nicotine, pesticides;
- a) Monitoring harmful factors in the occupational environment

- b) Have plans and procedures for safe storage, use, maintenance, inspection, and calibration of equipment according to regulations of competent authorities or manufacturers;
- c) Have procedures for operating equipment for sampling, storage, measurement, testing, and analysis of occupational conditions;
- d) Have an office with sufficient space to ensure quality monitoring, laboratory conditions must meet quality requirements for sample preservation, handling, and analysis;
- đ) Fully equipped with personal protective equipment when performing occupational environment monitoring;
- e) Implement measures to ensure industrial hygiene, fire safety, biological safety, chemical safety, and strictly comply with waste collection, transport, storage, and disposal regulations.

Article 34. Dossier and Procedures for Announcing Eligibility to Conduct Occupational Environment Monitoring
- The dossier for announcing eligibility to conduct occupational environment monitoring consists of:
- a) Request letter for announcing eligibility according to Form No. 01, Appendix III, issued with Decree 44/2016/ND-CP;
- b) Dossier for announcing eligibility following instructions in Form No. 02, Appendix III, issued with Decree 44/2016/ND-CP.
- Procedures for announcing eligibility:
- a) Before performing occupational environment monitoring, the head of the organization must submit the dossier to the Ministry of Health (for organizations under ministries/agencies) or Department of Health (for organizations under provincial/municipal management) where the organization is headquartered;
- b) Within 30 days of receiving the dossier, the Ministry or Department of Health shall announce eligibility on their official portal. If conditions are not met, a written explanation must be provided;
- c) Online dossier requirements:
- Ensure all documents and content match the paper version, converted to electronic form. The electronic file name must correspond to the paper document name;
- Information in the request letter and dossier must be complete and accurate;
- Organizations submitting online must retain the paper dossier.
- During operation, the organization must maintain conditions announced under Article 33 of Decree 44/2016/ND-CP.
- Organizations may only conduct monitoring after eligibility has been announced as specified in point b, Clause 2 of this Article.
Section 2. REGULATIONS ON OCCUPATIONAL ENVIRONMENT MONITORING
Article 35. Principles for Conducting Occupational Environment Monitoring under Decree 44/2016/ND-CP
- Monitor all harmful factors listed in the occupational hygiene dossier prepared by the workplace.
-
- For heavy, hazardous, and especially hazardous occupations, labor workload and some psychophysiological indicators (Ergonomics) must be assessed as specified in Clause 3, Article 33 of Decree 44/2016/ND-CP.
- Monitoring must follow the plan agreed between the workplace and a qualified monitoring organization.
- Occupational environment monitoring must ensure:
- a) Conducted during normal production and business activities;
- b) Samples taken using personal and location sampling methods in areas affecting workers;
- c) For rapid detection methods, if results are doubtful, samples must be analyzed in a qualified laboratory using appropriate methods.
- Harmful factors requiring monitoring must be updated in the occupational hygiene dossier in cases of:
- a) Changes in technology, production process, or workplace renovation/upgrading creating new harmful factors;
- b) Proposal by the monitoring organization during monitoring;
- c) Request by competent state authorities.
- The monitoring organization is entitled to payment for monitoring, occupational exposure assessment, reporting, and management fees by the employer in accordance with the law.
- The monitoring organization must report to the Ministry or Department of Health on newly identified harmful factors at the workplace for which no permissible limits are yet established.
Article 36. Basis for Developing Occupational Environment Monitoring Plans
- The workplace’s occupational hygiene dossier, production process, and number of workers exposed to harmful factors to determine the number of factors to monitor, number of samples, and sampling locations for each factor.
- Number of workers in heavy, hazardous, and especially hazardous occupations.
- Microorganisms, allergens, carcinogens, and other harmful factors potentially affecting workers’ health that are not yet included in the occupational hygiene dossier.
Article 37. Procedures for Conducting Occupational Environment Monitoring under Decree 44/2016/ND-CP
- Before monitoring, the organization must ensure all equipment is adjusted and calibrated according to regulations.
- Follow the committed occupational environment monitoring procedures fully and correctly.
- Report monitoring results truthfully to the employer.
- If results are unsatisfactory, the workplace must:
- a) Implement measures to improve working conditions, reduce harmful factors, and prevent occupational diseases;
- b) Organize health checks to detect occupational and related diseases early for workers in affected areas;
- c) Provide in-kind compensation to workers as per labor law.
Article 38. Management and Storage of Occupational Environment Monitoring Results under Decree 44/2016/ND-CP
- Occupational environment monitoring results are prepared according to Form No. 04, Appendix III, issued with Decree 44/2016/ND-CP, in two copies: one copy sent to the workplace that signed the monitoring contract and one copy retained by the monitoring organization.
- The retention period of occupational environment monitoring results must comply with legal regulations.
Chapter V: IMPLEMENTATION ORGANIZATION
Article 39. Responsibilities of the Ministry of Labor, Invalids and Social Affairs under Decree 44/2016/ND-CP
- Organize information dissemination, guidance on implementing Decree 44/2016/ND-CP through mass media at the central level; provide training and guidance to ministries, sectors, localities, organizations, and relevant unions in implementation, inspection, and supervision.
- Specify the form, content, program, and implementation of training, retraining, and professional assessment for occupational safety and hygiene trainers; update training on policies, law, science, and technology for trainers and heads of training organizations; manage and deploy occupational safety and hygiene training activities.
- Develop a database on occupational safety technical inspection and occupational safety training.
- Manage machines, equipment, materials, and substances with strict occupational safety and hygiene requirements according to authority in Appendix Ib issued with this Decree.
- Specify the form, content, program, and implementation of training, retraining, and professional assessment for inspection of machines, equipment, materials, and substances with strict occupational safety and hygiene requirements for subjects under management; manage and deploy occupational safety technical inspection activities.
- Issue, renew, reissue Certificates of Eligibility for occupational safety technical inspection, Certificates of Eligibility for occupational safety and hygiene training, and reissue inspector certificates under management authority.
Announce organizations eligible for occupational safety technical inspection and occupational safety and hygiene training; suspend or revoke Certificates of Eligibility for organizations violating regulations.
- Guide and implement support policies for training workers in areas without labor contracts performing tasks with strict occupational safety and hygiene requirements.
- Lead and coordinate annual and ad-hoc inspections of organizations performing occupational safety technical inspection, occupational safety and hygiene training, and monitoring occupational environment at production and business facilities.
- Lead and coordinate with competent authorities to handle complaints and denunciations related to occupational safety technical inspection, occupational safety training, and occupational environment monitoring as prescribed by law.
- Annually, guide localities in planning and estimating training support budgets for workers as specified in Article 32 of Decree 44/2016/ND-CP, consolidate budget needs, submit to the Ministry of Finance for decision, and guide implementation.
Article 40. Responsibilities of the Ministry of Health under Decree 44/2016/ND-CP
- Lead management and inspection of issuing certificates for occupational health, first aid, and emergency training at workplaces; announce medical units eligible to issue occupational health certificates and provide first aid/emergency training as per authority.
Direct Departments of Health to manage and inspect announcements of medical units eligible to issue occupational health certificates and conduct first aid/emergency training in their jurisdiction.
- Coordinate with the Ministry of Labor, Invalids and Social Affairs to develop detailed framework programs for occupational health, first aid, emergency response, occupational hygiene, and occupational disease training.
- Regulate, implement, and manage occupational environment monitoring at workplaces.
- Develop a database on occupational environment monitoring; announce organizations eligible to conduct monitoring; suspend or sanction violating organizations on the Ministry’s website.
- Direct occupational environment monitoring in industrial parks or clusters with high occupational disease risk.
- Coordinate with the Ministry of Labor, Invalids and Social Affairs and localities to inspect and supervise occupational environment monitoring, occupational hygiene training, first aid/emergency training, and inspection of machines, equipment, and materials with strict safety requirements.
- Coordinate with the Ministry of Labor, Invalids and Social Affairs and localities to disseminate and detail this Decree.
- Annually consolidate occupational environment monitoring results and submit to the Ministry of Labor, Invalids and Social Affairs for Government reporting.
Article 41. Responsibilities of the Ministry of Finance under Decree 44/2016/ND-CP
- Lead and coordinate with the Ministry of Labor, Invalids and Social Affairs to consolidate central budget training support needs, and submit to competent authorities for funding decisions according to state budget law.
- Lead and coordinate with the Ministry of Labor, Invalids and Social Affairs and sector-managing ministries to regulate fees for assessing eligibility for occupational safety technical inspection and occupational safety and hygiene training services, including collection, submission, management, and use of fees.
Article 42. Responsibilities of Sector-Managing Ministries under Decree 44/2016/ND-CP
- Specify the form, content, program, and implementation of training, retraining, and professional assessment for inspection of machines, equipment, materials, and substances with strict occupational safety and hygiene requirements; manage and deploy occupational safety technical inspection activities under authority.
- Coordinate with the Ministry of Labor, Invalids and Social Affairs to develop detailed sector-specific training programs.
- Coordinate with the Ministry of Labor, Invalids and Social Affairs and the Ministry of Health to inspect and supervise occupational safety technical inspection, occupational safety and hygiene training, first aid/emergency training, and occupational environment monitoring.
- Issue, renew, reissue, or revoke Certificates of Eligibility for occupational safety technical inspection and reissue inspector certificates under authority.
- Within 15 days of issuing, renewing, reissuing, or revoking a Certificate of Eligibility, notify the Ministry of Labor, Invalids and Social Affairs in writing.
- Manage machines, equipment, materials, and substances with strict occupational safety and hygiene requirements under authority as listed in Appendix Ib of this Decree.
- By December 25 annually or ad-hoc, submit reports to the Ministry of Labor, Invalids and Social Affairs on inspection activities under their authority.
Article 43. Responsibilities of Provincial/City People’s Committees under Decree 44/2016/ND-CP
- Manage and organize occupational safety technical inspection, occupational safety and hygiene training, and occupational environment monitoring in their jurisdiction.
- Direct relevant Departments and sectors to coordinate with local political-social organizations in inspection, supervision, and guidance of occupational safety technical inspection, occupational safety and hygiene training, and environment monitoring.
- Consolidate training support needs for workers without labor contracts in jobs with strict safety and hygiene requirements and submit to local People’s Councils for approval.
Article 44. Responsibilities of Organizations Conducting Occupational Safety Technical Inspection, Occupational Safety and Hygiene Training, and Occupational Environment Monitoring
- Ensure compliance with conditions during operations as prescribed in this Decree.
- By December 15 annually, report in writing operational results to the Ministry of Labor, Invalids and Social Affairs, local Departments of Labor, Invalids and Social Affairs, and competent authorities for Certificate issuance according to Form Ic, and send an email to antoanlaodong@molisa.gov.vn.
- By December 15 annually, occupational safety and hygiene training organizations report operational results to the Ministry of Labor, Invalids and Social Affairs and local Departments according to Form No. 05, Appendix II, and send an email to the Ministry of Labor, Invalids and Social Affairs at antoanlaodong@molisa.gov.vn.
- By December 15 annually, occupational environment monitoring organizations report operational results to the Ministry of Health or relevant Department of Health, and send an email to baocaoytld@moh.gov.vn.
Report newly identified or emerging hazardous factors at workplaces to the Ministry of Health or relevant Department, and propose updates to the workplace’s occupational hygiene dossier.
- When changing headquarters or branch addresses, notify the competent authority issuing Certificates at least 7 working days before the change.
- If there is a need to change inspection, training, or monitoring scope, submit a request for modification; upon ceasing activities, notify the competent authority issuing Certificates or announcing eligibility.
- Retain all legal documents and records related to occupational safety technical inspection, occupational safety and hygiene training, and occupational environment monitoring.
- Every two years, heads of occupational safety and hygiene training organizations must attend refresher courses organized by the Ministry of Labor, Invalids and Social Affairs.
- Every two years, heads of occupational environment monitoring organizations must attend refresher courses organized by the Ministry of Health.
Article 45. Responsibilities of Production and Business Facilities under Decree 44/2016/ND-CP
- Review and classify subjects for training, list machines, equipment, materials with strict safety requirements, and workplaces with occupational risks; plan and organize occupational safety technical inspection, occupational safety and hygiene training, and occupational environment monitoring as prescribed by law. Update occupational hygiene dossier when production processes change or when renovation/upgrading introduces new hazards.
- Develop detailed training programs and materials based on framework programs and organize worker training. If training is outsourced, the training organization must develop programs including content tailored to the facility’s specific requirements.
- By December 31 annually, submit reports on occupational safety technical inspection, training, and monitoring to local authorities:
- a) Report to the Department of Labor, Invalids and Social Affairs on safety and hygiene implementation;
- b) Report to the Department of Health on occupational environment monitoring.
- Pay full wages and ensure other benefits for participants during training as required by law.
- Pay fees for inspection, training, and monitoring; include costs in production/business expenses.
- If employing workers under contract, subcontract, or labor lease, the employer is responsible for organizing occupational safety and hygiene training.
- Retain records including inspection results, training programs, trainee lists, assessment results, trainer qualifications, and monitoring records.
Chapter VI: IMPLEMENTING PROVISIONS OF DECREE 44/2016/ND-CP
Article 46. Transitional Provisions under Decree 44/2016/ND-CP
- Organizations with Certificates or recognized eligibility before the effective date of Decree 44/2016/ND-CP may continue operations until the end of their recognized period. Inspections and training must meet the conditions of this Decree.
- Certificates for inspectors, training instructors, and previously issued training certificates remain valid until expiry.
- State or international organization training programs in Vietnam must comply with the Decree’s training conditions, and participants will receive certificates, safety cards, or recognition of training results accordingly.
- Organizations conducting occupational environment measurement before the Decree’s effective date may continue operations but must announce eligibility by July 1, 2017.
Article 47. Effectiveness of Decree 44/2016/ND-CP
- Decree 44/2016/ND-CP takes effect from July 1, 2016.
- The provisions on labor safety technical inspection activities in Articles 15, 16, 17, 18, 19, 20, 21, 22, 23, and 24 of Section 3; labor safety and hygiene training activities specified in Point d, Clause 1, Article 25 of Decree No. 45/2013/ND-CP dated May 10, 2013 of the Government detailing and guiding the implementation of certain articles of the Labor Code on working hours, rest periods, and labor safety and hygiene shall cease to be effective from the date Decree 44/2016/ND-CP comes into force.
- Labor safety technical inspection activities, labor safety and hygiene training, and occupational environment monitoring in the fields of national security and defense shall follow the provisions of this Decree, except where other legal documents in these fields provide otherwise.
- The Ministers, heads of ministerial-level agencies, heads of government agencies, and Chairpersons of People’s Committees of provinces and centrally-run cities shall be responsible for implementing this Decree based on their assigned functions and tasks./.
