CIRCULAR
GUIDELINES ON MANAGEMENT OF OCCUPATIONAL HYGIENE AND EMPLOYEES’ HEALTH
Pursuant to the Labor Code dated June 18, 2012, of the National Assembly;
Pursuant to the Law on Occupational Safety and Hygiene dated June 25, 2015, of the National Assembly;
Pursuant to Decree No. 39/2016/NĐ-CP dated May 15, 2016, of the Government detailing the implementation of a number of articles of the Law on Occupational Safety and Hygiene;
Pursuant to Decree No. 44/2016/NĐ-CP dated May 15, 2016, of the Government detailing a number of articles of the Law on Occupational Safety and Hygiene regarding technical inspection of occupational safety, training in occupational safety and hygiene, and monitoring of the working environment;
Pursuant to Decree No. 63/2012/NĐ-CP dated August 03, 2012, of the Government defining the functions, tasks, powers, and organizational structure of the Ministry of Health;
At the proposal of the Director of the Health Environment Management Agency;
The Minister of Health hereby issues the Circular guiding the management of occupational hygiene and employees’ health.
Chapter I: MANAGEMENT OF OCCUPATIONAL HYGIENE AND EMPLOYEES’ HEALTH
Article 1. Content of occupational hygiene management
- The content of occupational hygiene management at a labor facility includes:
- Establishing and updating occupational hygiene records of the labor facility;
- Monitoring of the working environment;
- Health examination before job placement, periodic health examination, examination for detection of occupational diseases, and periodic examination for occupational diseases;
- Controlling, preventing, and minimizing the effects of harmful factors in the working environment on health;
- Hygiene for disease prevention, ensuring food safety, and promoting health at the workplace;
- Ensuring compliance with requirements regarding sanitary and welfare facilities at the workplace as prescribed in Appendix 1 issued herewith;
- Organizing forces for first aid and emergency aid for occupational accidents at the workplace (hereinafter referred to as first aid, emergency aid) and ensuring equipment for first aid and emergency aid.
- Annually, production and business establishments must develop contents for occupational hygiene management and employee health management within the facility’s occupational safety and hygiene plan.
Article 2. Requirements for employee health management
- The management, health care, and prevention of occupational diseases for employees must be implemented from the time the employee is recruited and throughout the working process at the labor facility.
- The arrangement and assignment of job positions must be suitable to the health condition of the employee while meeting the following requirements:
- Do not assign people suffering from occupational diseases to work at positions exposed to the harmful factors causing that occupational disease if exposure to these harmful factors has not been controlled or minimized;
- Limit the assignment of employees suffering from chronic diseases to work at positions with harmful factors related to their existing diseases. In cases where employees with chronic diseases must be assigned to work at positions with harmful factors related to their existing diseases, the employer must fully explain the harmful factors to the employee’s health and may only assign the work after obtaining the employee’s written consent.
Article 3. Employee health management records in Circular 19/2016/TT-BYT
- Employee health management records include:
- Personal health records of the employee;
- Records managing the health and disease status of all employees working at the labor facility (hereinafter referred to as Health and Disease Management Records).
- Personal health records of the employee include:
- Health certificate or Health Examination Form before job placement for cases where employees are exposed to harmful factors causing occupational diseases, employees doing heavy, toxic, dangerous jobs and strictly heavy, toxic, dangerous jobs according to current legal regulations;
- Periodic Health Examination Book or Health Examination Book for detection of occupational diseases for cases where employees are exposed to harmful factors causing occupational diseases, employees doing heavy, toxic, dangerous jobs and strictly heavy, toxic, dangerous jobs according to current legal regulations;
- Occupational disease file of the employee (if any);
- Discharge papers, sick leave papers, or relevant treatment documents (if any).
- Health and Disease Management Records shall be implemented according to the form prescribed in Appendix 2 issued herewith.
Article 4. Management of occupational accident emergency aid records in Circular 19/2016/TT-BYT
- All cases of occupational accidents or poisoning at the workplace must have an occupational accident emergency aid record established.
- Occupational accident emergency aid records shall be implemented according to the form prescribed in Appendix 3 issued herewith and must be kept at the labor facility according to current legal regulations.
Chapter II: FIRST AID, EMERGENCY AID AT THE WORKPLACE
Article 5. Requirements for first aid and emergency aid activities
- The arrangement of first aid and emergency aid forces, equipment, means, and materials for first aid and emergency aid must be based on the following factors:
- Type of production, nature of dangerous and harmful factors;
- Number of employees, number of work shifts; arrangement of work shifts;
- Risk of accidents that may occur at the workplace;
- Distance from the workplace to the nearest medical facility;
- Rate of occupational accidents (if any).
- For working positions using toxic chemicals or corrosive substances, emergency showers and eye wash facilities must be equipped at easily accessible locations within the working area and maintained according to the manufacturer’s regulations or legal regulations (if any).
- For workplaces using chemicals classified as hazardous chemicals according to the law on chemicals, there must be a chemical safety data sheet in Vietnamese, clearly stating instructions on first aid and emergency aid for that type of chemical, placed near the location of the first aid kit for easy access. If the chemical used has an antidote, the antidote and instructions for use in Vietnamese must be available in the first aid kit.
- Have a first aid and emergency aid force meeting the conditions prescribed in Article 7 of this Circular.
- Publicly announce information regarding the location and quantity of first aid kits, equipment, emergency means, first aid/emergency rooms or areas, and the list of members of the first aid and emergency aid force at the working areas of the labor facility so that employees know and use them when necessary.
- First aid and emergency aid equipment and means (including first aid kits) and the number of people performing first aid and emergency aid work must be periodically inspected and reviewed to ensure they are always in good working condition and suitable for the requirements prescribed in this Circular.
Article 6. Regulations on first aid kits in Circular 19/2016/TT-BYT
- First aid kits must be placed at the employees’ working area, in a visible and easily accessible place, marked with a cross symbol.
- The content and quantity of first aid kits shall be implemented according to the regulations in Appendix 4 issued herewith.
Article 7. Organization of first aid and emergency aid forces
- The first aid and emergency aid force includes:
- Employees assigned by the employer to participate in the first aid force. The assignment of employees to participate in the first aid force must meet the following criteria:
- Have sufficient health and volunteer to participate in first aid and emergency aid activities;
- Can be present earliest at the location where the occupational accident occurs to support first aid and emergency aid during working hours;
- Trained in first aid and emergency aid according to the instructions in Article 9 of this Circular.
- Medical staff at the production and business establishment.
- Employees assigned by the employer to participate in the first aid force. The assignment of employees to participate in the first aid force must meet the following criteria:
- For production and business establishments with jobs belonging to the List of jobs with strict requirements on occupational safety and hygiene, the employer shall arrange and assign the number of employees doing first aid and emergency aid work as follows:
- Under 100 employees: must arrange at least 01 employee doing first aid and emergency aid work;
- For every additional 100 employees: must arrange at least 01 additional employee doing first aid and emergency aid work.
- For other production and business establishments, the employer shall arrange and assign the number of employees doing first aid and emergency aid work as follows:
- Under 200 employees: must arrange at least 01 employee doing first aid and emergency aid work;
- For every additional 150 employees: must arrange at least 01 additional employee doing first aid and emergency aid work.
- Ensure that each work shift or mobile work group has a person or force responsible for first aid and emergency aid.
Article 8. Requirements for first aid and emergency aid areas
- In cases where over 300 people work concentrated on the same premises, a first aid and emergency aid area must be arranged.
- The first aid and emergency aid area must meet the minimum requirements as follows:
- Must be large enough to place a stretcher and have space for the victim of the occupational accident to lie down, be ventilated, lit, and have signage (cross symbol);
- Located near the toilet, easily accessible to the labor and production area, and convenient for first aid, emergency aid, or transportation of employees when occupational accidents occur;
- The list of equipment for the first aid and emergency aid area shall be implemented according to the regulations in Appendix 5 issued herewith.
Article 9. Training on first aid and emergency aid in Circular 19/2016/TT-BYT
- Subjects for first aid and emergency aid training include:
- Employees, except for those who already have a Certificate of Occupational Safety and Hygiene training;
- Persons assigned to participate in the first aid and emergency aid force.
- The time, content of training, and annual retraining shall be implemented according to the regulations in Appendix 6 issued herewith.
- Trained persons must sign the First Aid and Emergency Aid Training Tracking Book according to the form prescribed in Appendix 7 issued herewith after being trained. In case the employee already has a Certificate of Occupational Safety and Hygiene training, they do not have to sign the First Aid and Emergency Aid Training Tracking Book but must keep a copy of the Certificate of Occupational Safety and Hygiene training.
Chapter III: REGULATIONS ON REPORTING REGIME
Article 10. Grassroots level in Circular 19/2016/TT-BYT
- Reporting unit and content:
- Labor facilities perform occupational health reporting according to the form prescribed in Appendix 8 issued herewith;
- Medical examination and treatment facilities at the district level and Commune, Ward, and Town Health Stations perform reporting on cases of occupational accidents examined and treated at the unit according to the form prescribed in Decree No. 39/2016/NĐ-CP dated May 15, 2016, of the Government detailing the implementation of a number of articles of the Law on Occupational Safety and Hygiene (hereinafter referred to as Decree No. 39/2016/NĐ-CP).
- Unit receiving the report:
- Health Center of the district, town, or provincial city (hereinafter referred to as Health Center) where the labor facility’s headquarters is located;
- The ministry or sector health management unit in case the labor facility is under the management of a ministry or sector.
- Time to send reports:
- Before July 5th annually for the first 6-month report;
- Before January 10th of the following year for the annual report.
Article 11. District level in Circular 19/2016/TT-BYT
- Reporting unit and content:
- The Health Center performs occupational health reporting according to the form prescribed in Appendix 9 issued herewith;
- Medical examination and treatment facilities at the provincial level perform reporting on cases of occupational accidents examined and treated at the units according to the form prescribed in Decree No. 39/2016/NĐ-CP.
- Unit receiving the report: Department of Health.
- Time to send reports:
- Before July 10th annually for the first 6-month report;
- Before January 15th of the following year for the annual report.
Article 12. Provincial level in Circular 19/2016/TT-BYT
- Reporting unit and content:
- The Department of Health and Ministry/Sector health management units perform occupational health reporting according to the form prescribed in Appendix 10 issued herewith;
- The Department of Health performs reporting on the list of units eligible for working environment monitoring in the area according to the form prescribed in Appendix 11 issued herewith.
- Unit receiving the report: Ministry of Health (Health Environment Management Agency).
- Time to send reports:
- For occupational health reports:
- Before July 15th annually for the first 6-month report;
- Before January 25th of the following year for the annual report.
- For reports on the list of units eligible for working environment monitoring: Within 03 working days from the date the Department of Health announces the unit eligible for working environment monitoring on the Department of Health’s electronic information portal.
- For occupational health reports:
Chapter IV: IMPLEMENTATION RESPONSIBILITIES
Article 13. Responsibilities of persons doing medical work at labor facilities regarding first aid and emergency aid work
- Periodically inspect and review the organization of first aid and emergency aid; equipment, means of first aid and emergency aid, and the number of persons doing first aid and emergency aid work at the labor facility.
- Manage and organize training for employees and employees assigned to participate in the first aid force as prescribed in Article 9 of this Circular.
- Propose to the employer:
- Supplement members of the first aid and emergency aid force when members of the first aid and emergency aid force quit or transfer jobs;
- Supplement, replace, maintain, and inspect first aid and emergency aid equipment and means.
Article 14. Responsibilities of employers in Circular 19/2016/TT-BYT
- Establish, manage, and supplement occupational hygiene records, personal health records of employees, records managing the health status of employees at the labor facility, personal occupational disease records (if any), occupational accident first aid and emergency aid records (if any), and monitor the health and progression of occupational diseases of employees.
- Arrange and assign job positions suitable to employees’ health as prescribed in Clause 2 Article 2 of this Circular.
- Ensure the provision of sufficient sanitary and welfare facilities for use at the workplace.
- Fully equip first aid and emergency aid equipment and means; organize the first aid and emergency aid force and have a written assignment of the person managing the first aid and emergency aid force; organize first aid and emergency aid training.
Article 15. Responsibilities of Commune, Ward, and Town Health Stations in the work of protecting and caring for employees’ health
- Participate in initial first aid and emergency aid for cases of occupational accidents, poisoning by chemicals, and other accidents occurring in the area when requested.
- Information, propaganda, and health education on epidemic prevention hygiene and occupational disease prevention;
- Compile statistics on the number of labor facilities and harmful factors in the working environment to have measures to guide health care for employees.
- Inspect occupational hygiene work and occupational disease prevention in the managed area.
Article 16. Responsibilities of Health Centers of districts, towns, and provincial cities
- Manage, inspect, and examine the situation of occupational hygiene and employee health at labor facilities in the area according to decentralization.
- Communicate, educate, guide, supervise, train, and provide professional and technical training on occupational hygiene, employee health (including occupational disease prevention), first aid, and emergency aid for labor facilities in the managed area according to decentralization.
- Organize briefings with persons doing medical work of labor facilities within the scope of management to improve professional expertise, update legal documents, and coordinate in the management of employee health care periodically every 6 months.
Article 17. Responsibilities of Preventive Medicine Centers or Centers for Occupational Health and Environment of provinces and centrally-run cities
- Manage, inspect, and examine the situation of occupational hygiene and employee health at labor facilities in the area according to decentralization.
- Develop plans for occupational hygiene management, care, health promotion, occupational disease prevention, first aid, and emergency aid training for employees in the area, submit to the Department of Health for approval, and organize implementation.
- Communicate, educate, guide, supervise, train, and provide professional and technical training on occupational hygiene, employee health (including occupational disease prevention), first aid, and emergency aid for labor facilities in the managed area according to decentralization.
- Organize briefings with persons doing medical work of labor facilities within the scope of management to improve professional expertise, update legal documents, and coordinate in the management of employee health care periodically every 6 months.
Article 18. Responsibilities of Ministry and Sector Health in Circular 19/2016/TT-BYT
- Develop plans for occupational hygiene work, care, health promotion, occupational disease prevention, first aid, and emergency aid for employees within the scope of management, submit to the ministry or sector for approval, and organize implementation.
- Inspect, direct, guide, supervise, train, and provide professional and technical training on occupational hygiene, employee health (including occupational disease management), first aid, and emergency aid for labor facilities within the scope of management.
- Research and propose amendments and supplements to: the list of heavy, toxic, dangerous and strictly heavy, toxic, dangerous jobs; specialized health standards and standards for elderly employees doing heavy, toxic, dangerous and strictly heavy, toxic, dangerous jobs within the scope of management of the Ministry or Sector.
Article 19. Responsibilities of the Department of Health in Circular 19/2016/TT-BYT
- Direct, organize, and decentralize the implementation of occupational hygiene management, employee health management, and occupational diseases under management authority.
- Direct the organization of communication, education, guidance, supervision, training, and professional and technical training on occupational hygiene, employee health (including occupational disease prevention), first aid, and emergency aid in the managed area.
- Inspect, examine, and supervise the activities of organizations announcing eligibility for working environment monitoring, medical facilities providing health care services for employees, occupational disease examination facilities, training for Occupational Health certificates, and first aid and emergency aid training within the scope of management in the area.
Article 20. Responsibilities of Institutes under the preventive medicine system, Universities with majors in Medicine, Public Health, and Occupational Health
- Organize professional technical guidance on occupational health, occupational hygiene, working environment monitoring, occupational diseases, first aid, and emergency aid.
- Develop materials and organize training to issue certificates on working environment monitoring and certificates on occupational diseases according to the training program framework prescribed in Appendix 12 issued herewith. Certificates on working environment monitoring shall be implemented according to the form prescribed in Appendix 13 issued herewith.
Review certificates and certifications on measurement, inspection, and supervision of the working environment issued by their facility before the effective date of this Circular to issue certificates certifying working environment monitoring for cases where certificates and certifications on measurement, inspection, and supervision of the working environment have been issued with content and training time equivalent to the training program framework prescribed in Appendix 12 issued herewith.
- Perform working environment monitoring and employee health care at industrial zones as assigned by the Ministry of Health.
- Organize communication, education, guidance, supervision, training, and professional technical training on occupational hygiene, employee health (including occupational disease prevention), first aid, and emergency aid.
- Research and propose health standards for employees in various professions; health standards for elderly employees doing heavy, toxic, dangerous and strictly heavy, toxic, dangerous jobs, and propose amendments and supplements to the list of heavy, toxic, dangerous and strictly heavy, toxic, dangerous jobs in the health sector.
Article 21. Responsibilities of the Administration of Medical Services – Ministry of Health
- Direct and guide the organization of health examinations for certification and periodic health examinations according to authority.
- Direct and guide the treatment and functional rehabilitation of occupational diseases nationwide.
- Announce medical examination and treatment facilities eligible for periodic health examinations and functional rehabilitation on the electronic information portal of the Ministry of Health. Synthesize and report data on periodic health examinations and functional rehabilitation for employees nationwide.
- Develop and submit to competent authorities for promulgation regulations on health classification standards for employees; treatment regimens and functional rehabilitation for occupational diseases.
- Inspect and examine the activities of medical examination and treatment facilities prescribed in Clause 3 of this Article.
Article 22. Responsibilities of the Health Environment Management Agency – Ministry of Health
- Develop plans for occupational hygiene management, care, employee health promotion, occupational disease prevention, first aid, and emergency aid nationwide, submit to competent authorities for approval, and organize implementation.
- Direct and organize the implementation of occupational hygiene management, employee health management, occupational disease prevention, first aid, and emergency aid nationwide.
- Announce on the Electronic Information Portal of the Ministry of Health information on organizations announcing eligibility for working environment monitoring, medical units eligible to issue occupational health certificates, and medical units performing first aid and emergency aid training.
- Inspect and examine the activities of organizations announcing eligibility for working environment monitoring, occupational disease examination facilities, medical units eligible to issue occupational health certificates, and medical units performing first aid and emergency aid training nationwide.
- Synthesize data on the situation of occupational hygiene, working environment monitoring, employee health care, occupational disease situation, and occupational accident cases examined and treated at medical facilities.
Chapter V: IMPLEMENTATION PROVISIONS
Article 23. Reference Clause
In case the documents referenced in this Circular are replaced or amended and supplemented, the replacing or amending and supplementing documents shall apply.
Article 24. Transitional Provisions
Employee health management records and Occupational accident emergency aid records established according to the guidance in Circular No. 19/2011/TT-BYT dated June 06, 2011, of the Ministry of Health guiding the implementation of occupational hygiene management, employee health management, and occupational diseases may continue to be used after the effective date of this Circular but must be finalized according to the regulations in this Circular before December 31, 2017.
Article 25. Effect
This Circular takes effect from August 15, 2016.
Circular No. 19/2011/TT-BYT dated June 06, 2011, of the Ministry of Health guiding the implementation of occupational hygiene management, employee health management, and occupational diseases and Circular No. 09/2000/TT-BYT dated April 28, 2000, of the Ministry of Health guiding employee health care in small and medium enterprises cease to be effective from the date this Circular takes effect.
During the implementation process, if any difficulties arise, organizations, units, and individuals are requested to promptly reflect to the Ministry of Health (Health Environment Management Agency) for research and consideration./.

REGULATIONS ON FIRST AID KITS AT THE WORKPLACE
1. General Requirements
- The quantity of first aid kits equipped must be suitable for the number of employees as prescribed in Section 2;
- For each floor or working level or mobile working unit, at least 01 suitable first aid kit must be arranged;
- First aid kits at the workplace must have sufficient minimum necessary equipment for first aid as prescribed in Section 3. Do not use to contain other items;
- Regularly check to ensure sufficient quantity and contents of the first aid kit as prescribed.
2. Regulations on quantity of kits for working areas

CONTENT AND TIME FOR FIRST AID TRAINING AT THE WORKPLACE
I. Initial Training
Training duration:
- For employees: 4 hours;
- For first aid and emergency response personnel: 16 hours (2 days).
Training content:
- Basic principles of on-site first aid and emergency response
- Wound dressing (Principles, means used for dressing, dressing techniques)
- Temporary bleeding control techniques (Principles of bleeding control, temporary bleeding control measures)
- Temporary fracture immobilization techniques (Principles of fracture immobilization, means for fracture immobilization)
- Cardiopulmonary resuscitation (CPR) techniques (Recognizing signs of circulatory and respiratory arrest, guiding airway clearance and assisted breathing, guiding CPR)
- Burn management; (Assessing the cause and degree of burn, on-site emergency burn management)
- Methods of safe victim transportation without a stretcher and with a stretcher for initial emergency aid
- Types of emergency response:
- Electric shock emergency response
- Drowning emergency response
- Chemical accident emergency response
- General guidance on the content and use of the first aid kit
- General practice for all contents
II. Annual Refresher Training
Training content shall be implemented according to the provisions in section 1 with the following duration:
- For employees: 2 hours;
- For first aid and emergency response personnel: 8 hours (1 day).

I. Training Content for Certification in Occupational Environment Monitoring
Minimum training duration: 01 month.
Content:
- General introduction to occupational safety and health
- Planning for occupational environment monitoring
- Methods for measuring and evaluating physical factors in the occupational environment
- Methods for measuring and evaluating dust factors in the occupational environment;
- Methods for measuring and evaluating chemical factors in the occupational environment
- Methods for measuring and evaluating work physiological and psychological factors and ergonomics
- Methods for assessing occupational exposure to biological factors, allergens, carcinogenic factors, etc.
- Fieldwork and practical training at the workplace for occupational environment monitoring
- Data synthesis, reporting, and proposing effective preventive advice for harmful factors in the occupational environment
II. Training Content for Certification in Occupational Diseases
Minimum training duration: 03 months. For specialized orientation training in occupational diseases, current regulations shall apply.
Content:
- General overview of occupational diseases
- General overview of basic respiratory diseases, basic ear, nose, and throat diseases
- General overview of basic dermatological diseases
- General overview of basic cardiovascular diseases
- Group of occupational respiratory diseases, basic diagnostic techniques, and preventive measures
- Technique for reading chest X-rays for pneumoconiosis according to the International Labour Organization classification guidelines
- Group of diseases caused by occupational physical factors, basic diagnostic techniques, and preventive measures
- Group of occupational poisoning diseases, basic diagnostic techniques, and preventive measures
- Group of occupational skin diseases, basic diagnostic techniques, and preventive measures
- Group of occupational diseases caused by biological agents, basic diagnostic techniques, and preventive measures
- Data synthesis, reporting, and proposing effective preventive advice for occupational diseases in the work environment
