CIRCULAR

Issuing the List of Machinery, Equipment, Supplies, and Substances Subject to Strict Requirements

on Occupational Safety and Hygiene

Pursuant to the Law on Occupational Safety and Hygiene No. 84/2015/QH13 dated June 25, 2015;

Pursuant to Decree No. 44/2016/NĐ-CP dated May 15, 2016, of the Government detailing a number of articles of the Law on Occupational Safety and Hygiene regarding technical safety inspection activities, occupational safety and hygiene training and working environment monitoring;

Pursuant to Decree No. 14/2017/NĐ-CP dated February 17, 2017, of the Government defining the functions, tasks, powers, and organizational structure of the Ministry of Labor – Invalids and Social Affairs;

Upon the proposal of the Director of the Department of Work Safety;

The Minister of Labor – Invalids and Social Affairs promulgates the Circular issuing the List of Machinery, Equipment, Supplies, and Substances Subject to Strict Requirements on Occupational Safety and Hygiene.

Article 1. List of Machinery, Equipment, Supplies, and Substances Subject to Strict Requirements on Occupational Safety and Hygiene in Circular No. 36/2019/TT-BLĐTBXH

Attached to this Circular is the List of Machinery, Equipment, Supplies, and Substances Subject to Strict Requirements on Occupational Safety and Hygiene.


Article 2. Organization of Implementation of Circular No. 36/2019/TT-BLĐTBXH

     

  1. Based on the socio-economic development situation and state management requirements, the Ministries, according to their management authority over machinery, equipment, supplies, and substances subject to strict requirements on occupational safety and hygiene specified in Article 33 of the Law on Occupational Safety and Hygiene, shall send an official letter to the Ministry of Labor – Invalids and Social Affairs when proposing amendments or additions to the List, with the following contents:
       

    • a) Name of the machinery, equipment, supplies, or substance to be amended or added to the List, including scientific names and trade names (if any);
    •  

    • b) Assessment of the necessity, feasibility, and impact of amending or adding the types of machinery, equipment, supplies, and substances to the List (accompanied by draft inspection procedures, if any).
  2.  

  3. The Department of Work Safety under the Ministry of Labor – Invalids and Social Affairs shall be responsible for compiling and reporting to the Ministry of Labor – Invalids and Social Affairs the proposals for amending and supplementing the List of machinery, equipment, supplies, and substances subject to strict requirements on occupational safety and hygiene from the Ministries as regulated.

  5. The Departments of Labor – Invalids and Social Affairs of provinces and centrally-run cities shall be responsible for coordinating with relevant agencies to disseminate and guide the implementation of this Circular to businesses, agencies, organizations, cooperatives, households, and individuals using machinery, equipment, supplies, and substances subject to strict requirements on occupational safety and hygiene in the locality; compiling and reporting annually to the Ministry of Labor – Invalids and Social Affairs on the implementation of this Circular together with the report on the local occupational safety and hygiene situation.

Article 3. Effectiveness of Circular No. 36/2019/TT-BLĐTBXH

     

  1. This Circular shall take effect from March 01, 2020.

  3. Circular No. 53/2016/TT-BLĐTBXH dated December 28, 2016, of the Ministry of Labor – Invalids and Social Affairs promulgating the List of Machinery, Equipment, Supplies, and Substances Subject to Strict Requirements on Occupational Safety and Hygiene, shall cease to be effective from the effective date of this Circular.
  4.  

  5. During the implementation, if any difficulties arise, agencies, organizations, and individuals should promptly report in writing to the Ministry of Labor – Invalids and Social Affairs for consideration and resolution./.

LIST

OF MACHINERY, EQUIPMENT, SUPPLIES, AND SUBSTANCES SUBJECT TO STRICT REQUIREMENTS ON OCCUPATIONAL SAFETY AND HYGIENE
(Issued together with Circular No. 36/2019/TT-BLĐTBXH dated December 30, 2019, of the Ministry of Labor – Invalids and Social Affairs)

I. Machinery, Equipment, and Supplies Subject to Strict Requirements on Occupational Safety

No. MACHINERY, EQUIPMENT, SUPPLIES, AND SUBSTANCES SUBJECT TO STRICT REQUIREMENTS ON OCCUPATIONAL SAFETY AND HYGIENE
1 Boilers of all types (including superheaters and economizers) with a rated operating steam pressure above 0.7 bar; hot water boilers with a medium temperature above $115^\circ \text{C}$.
2 Thermal oil heaters.
3 Piping systems for steam and hot water of classes I and II with an outer diameter of $51 \text{mm}$ or more, and piping systems of classes III and IV with an outer diameter of $76 \text{mm}$ or more, according to the classification in Vietnam National Standards TCVN 6158:1996 and TCVN 6159:1996.
4 Pressure vessels with a rated operating pressure higher than $0.7 \text{bar}$ (excluding hydrostatic pressure) according to the classification in Vietnam National Standard TCVN 8366:2010 and pressure vessels with a rated operating pressure above $210 \text{bar}$.
5 Tanks, vats (cisterns), and drums used for containing or transporting liquefied gas, liquefied petroleum gas, compressed natural gas, or liquids with an operating pressure higher than $0.7 \text{bar}$, or liquids or solids in powder form without pressure but which use gas with a pressure higher than $0.7 \text{bar}$ when discharged, according to the classification in Vietnam National Standard TCVN 8366:2010.
6 Cylinders of all types used for containing or transporting compressed gas, liquefied gas, compressed natural gas, liquefied petroleum gas, or dissolved gas with an operating pressure higher than $0.7 \text{bar}$.
7 Supply systems, preparation systems, and filling systems for compressed gas, liquefied gas, liquefied petroleum gas, or dissolved gas.
8 Fixed gas pipeline systems, offshore gas pipeline systems; Medical gas pipeline systems; Compressed gas, liquefied gas, or dissolved gas pipeline systems.
9 Refrigeration systems classified in TCVN 6739:2015, including: Using refrigerants of groups A3, B2L, B2, B3; Using refrigerants of group A2 with a system charge of $1.5 \text{kg}$ or more; Using refrigerants of groups A1, A2L, B1 with a system charge of $05 \text{kg}$ or more.
10 Cranes.
11 Overhead traveling cranes.
12 Gantry cranes, semi-gantry cranes.
13 Cableways for cargo; Cableways for passengers; Cableways in construction machinery, inclined shaft hoists, vertical shaft hoists.
14 Electric hoists; Hand-operated hoists with a lifting capacity of $1,000 \text{kg}$ or more.
15 Electric trolleys running on rails.
16 Electric winches used for lifting or pulling loads on an inclined plane; lifting tables; lifting platforms; lifting platforms used for lifting people to work at height; winches for lifting people to work at height.
17 Hand-operated winches with a lifting capacity of $1,000 \text{kg}$ or more.
18 Forklift trucks with an engine and a lifting capacity of $1,000 \text{kg}$ or more.
19 Personnel lifting vehicles: Self-propelled personnel lifting vehicles, personnel lifting vehicles using hydraulic drive mechanisms, chain-driven hand hoists lifting people to a height exceeding $2 \text{m}$.
20 Construction hoists for goods; construction hoists for goods and personnel; construction hoists for personnel; hoists used in construction work.
21 Elevators of all types.
22 Escalators; moving walkways for passengers.
23 Mobile performance stages.
24 Amusement rides: roller coasters, ferris wheels, slides carrying people to a height of $2 \text{m}$ or more, with a passenger movement speed of $3 \text{m/s}$ or more relative to the fixed floor, excluding sports competition equipment.
25 Cable car systems for passengers.
26 Winches, hoists with a lifting capacity of $1,000 \text{kg}$ or more used in underground mining.
27 Single hydraulic props, mobile frame supports, and self-advancing roof supports composed of single hydraulic props used for roof support in underground mining.
28 Internal combustion engines (Crankcase volume over $0.6 \text{m}^3$ or cylinder diameter over $200 \text{mm}$).
29 Explosion-proof transformers.
30 Explosion-proof electric motors.
31 Explosion-proof distribution and switching equipment (magnetic starters, soft starters, circuit breakers, automatic circuit breakers, inverters, earth leakage relays).
32 Explosion-proof control equipment (control panels, push-button boxes).
33 Explosion-proof generators.
34 Explosion-proof electric cables.
35 Explosion-proof lighting fixtures.
36 Electric detonating machines.
37 Sliding formwork systems.
38 Drilling machines, pile pressing machines, pile driving machines.
39 Independent concrete pumping systems.
40 Scaffolding, shoring, and load-bearing column systems.
41 Suspended platforms used for lifting people in construction work.
42 Radio broadcasting stations with a maximum transmission power of $150 \text{W}$ or more.
43 Television broadcasting stations with a maximum transmission power of $150 \text{W}$ or more.
44 Floating systems (Buoys, ferries, canoes, etc.).
45 Vehicles transporting oversized and overweight beams; beam launching vehicles.
